for Hall of Flowers Retailers
Business-to-Business Temporary Cannabis Event
Purpose
Hall of Flowers (“HoF”) is a temporary cannabis event, as defined and permitted by 16 CCR 5600, that is organized by CLTV8, a Department of Cannabis Control licensed event organizer with license number CEO 14-0000002-LIC. HoF is a business-to-business event, geared largely toward facilitating the wholesaling of future orders. The purpose of this standard operating procedure (“SOP”) is to provide structural insight into how HoF operates in compliance with the regulations of the Department of Cannabis Control and establish the steps exhibitors must take to display cannabis products in their booths as well as provide cannabis goods for sale via a licensed retailer at HoF.
Scope
This SOP applies to all CLTV8 personnel associated with HoF and all participating exhibitors, distributors, and retail partners.
Definitions
For the purpose of this division, the definitions in this section shall govern the construction of the division unless otherwise indicated.
Branded Merchandise. Clothing, hats, pencils, pens, keychains, mugs, water bottles, beverage glasses, notepads, lanyards, cannabis accessories, or other types of merchandise approved by the DCC with the name or logo of a commercial cannabis business licensed pursuant to the Act. Branded merchandise does not include items containing cannabis or any items that are considered food as defined by Health and Safety Code section 109935.
Cannabis Accessories. Any equipment, products or materials of any kind which are used, intended for use, or designed for use in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, smoking, vaporizing, or containing cannabis, or for ingesting, inhaling, or otherwise introducing cannabis or cannabis products into the human body. “Cannabis accessories” has the same meaning as in Health and Safety Code section 11018.2.
Cannabis Goods. (1) cannabis, including dried flower, as defined in the California Business and Professions Code 26001(f); and (2) products containing cannabis, as defined in the California Health and Safety Code 11018.1.
Cannabis Goods For Sale. Cannabis Goods that will be purchased by an Event Retailer and sold for a nominal value with the intent to be consumed on-site.
DCC. The Department of Cannabis Control.
Display Product. Cannabis Goods that will be placed within a qualified Exhibitor’s booth space for the sole purpose of showcasing. Display Products will not be sold or consumed and may not leave the applicable exhibitor’s booth at any time during HoF. All Display Products must comply with all applicable regulatory requirements.
Event Organizer. CLTV8, holding Temporary Cannabis Event License No. CEO 14-0000002-LIC with the DCC.
Event Retailers. A DCC licensed retailer, or microbusiness, who will be situated in the Retail Area and perform sales of Cannabis Goods For Sale.
Exhibitor. California state-licensed cannabis company
Retail Area. An area where retailers and microbusinesses perform sales of Cannabis Goods For Sale, as permitted by 16 CCR 5602.
HoF Retail Partner. Licensed commercial cannabis retailer that has partnered with Event Organizer to operate a compliant “pop-up” dispensary at the Event. The HoF Retail Partner and the HoF Distribution Partner will coordinate the intake and sale of all CGFS at the HoF event.
HoF Distribution Partner. Licensed commercial cannabis distributor that has partnered with Event Organizer or HOf Retail Partner in order to facilitate the distribution of CGFS to the HoF Event.
Guidelines for Event Retailers
Event Retailers must comply with the following requirements:
Provide an active and good-standing cannabis retail or microbusiness license from the DCC.
The Event Retailer (licensed retailer or licensed microbusiness) must prominently display their state license in plain sight of the public.
Only Cannabis Goods for Sale that have been delivered by a licensed distributor may be sold to consumers.
Provide a list of the Exhibitor cultivators, manufacturers or distributors from whom you will purchase or receive deliveries of Cannabis Goods.**
Except for small amounts of Cannabis Goods used for display, all Cannabis Goods for Sale must be stored in a secure, locked container that is not accessible to the public.
The Cannabis Goods being stored must not be left unattended.
You may share this container with other Event Retailers, but every Event Retailer using the container will be held responsible for any regulatory violations.
Cannabis Goods for Sale may not be removed from their packaging. In the case that Cannabis Goods are removed from their packaging, they must be destroyed.
Sales may take place solely in the retail area.
Prior to a sale, you must confirm, via valid identification, that the consumer is 21 years or older. Acceptable forms of identification must include the name, date of birth, height, gender, and photo of the person.
Cannabis Goods for Sale may only be sold to individuals holding applicable to token.
Sales may only take place during show hours. Please follow final show sales time by Show Management.
All sales must be properly recorded and retained in accordance with 16 CCR 5037.
All Cannabis Goods for Sale must be placed in an opaque exit package before being transferred to a consumer.
Returned Cannabis Goods for Sale may not be resold and must be destroyed.
You may not, in a single day, sell more than 28.5 grams of non-concentrated cannabis, 8 grams of concentrated cannabis, including concentrated cannabis contained in a cannabis product, and 6 immature plants to a single adult-use consumer.
You may not, in a single day, sell more than 8 ounces of medicinal cannabis or 12 immature plants to a single medicinal cannabis patient or caregiver.
You may not provide free Cannabis Goods to anyone.
All cannabis waste must be removed from its packaging and destroyed pursuant to the requirements of 16 CCR 5055.
Consumption Area
Access to this area is restricted to persons 21 years and older.
Sale or consumption of alcohol or tobacco are strictly forbidden anywhere on the premises of HoF, including, but not limited to, the consumption area.
Consumption may only take place outdoors.
Marketing Restrictions
Exhibitors must themselves confirm all advertising and marketing used is compliant with all applicable regulations.
Advertising and marketing may not be targeted toward individuals under 21 years of age.
Advertising and marketing may not include any misleading or fraudulent information.
Advertising of free Cannabis Goods or giveaways of any type of products, including non-cannabis products, on social media or any other platform is prohibited. This includes promotions such as: (a) buy one get one free; (b) free product with any donation; (c) contests, sweepstakes, or raffles.
Advertising and marketing may not include any prohibited or unsubstantiated health-related claims.
Destruction of Unsold Goods
Any Cannabis Goods or Cannabis Goods for Sale that have not been sold by the conclusion of HoF must be destroyed in accordance with the DCC’s regulations. Cannabis Goods, including Cannabis Goods for Sale may only be transported by a licensed distributor or licensed microbusiness.
